Why didn't Agoura Hills vote on the Agoura Road apartments?

Learn why Agoura Hills approved 54 apartments on Agoura Road through by-right review, what the city checked, and where to ask parcel-specific questions.

If you’re looking at property near Agoura Road, you may wonder why the apartment project at 29125 Agoura Road didn’t go to the City Council for an approval vote. The answer is that the City of Agoura Hills says this development qualified for a by-right process and was required to be approved without discretion.

That still involves review. The distinction is what the city can decide: whether the project meets objective standards, rather than whether the council wants to approve it.

Why wasn’t there a City Council approval vote?

The project didn’t need a City Council approval vote because the city says state law required approval through its by-right process.

In its National CORE Development Information update, the city explains that its 6th Cycle Housing Element Update, adopted in 2022, required it to create this process under state law and California Department of Housing and Community Development (HCD) requirements. Qualifying housing projects are approved based solely on whether they meet certain objective standards.

The Acorn’s April 2, 2026 report also described the project as qualifying for a ministerial, by-right permit pathway without City Council approval.

National CORE presented the proposal to the council in January 2025, according to the city’s project FAQ. That presentation and a discretionary approval vote are different things. The development information update says this development was required to be approved by-right and without discretion.

What does the city review under by-right approval?

The city reviews qualifying projects against measurable requirements for affordability, building design, height, setbacks, landscaping, parking, circulation and other site improvements.

These are the objective standards the city identifies in its development information update. By-right approval doesn’t mean the project skips those checks. It means the decision rests on those standards, with local discretion limited by state housing law.

There’s another part of that update to keep in view: state law grants affordable housing projects relief from local development standards that would preclude production of the allowable number of housing units. Ask Planning how that state-law relief applied to this project.

For a comparison, the Hawthorne Boulevard streamlined housing guide addresses another city’s process. Bring questions about the Agoura Road project’s standards to Agoura Hills Planning.

What is planned at 29125 Agoura Road?

The project consists of 54 apartment homes in one U-shaped, four-story building over one level of underground parking.

The project FAQ places the site on the north side of Agoura Road, about 300 feet east of the Agoura/Kanan intersection. All units have two or three bedrooms. The development will provide 81 parking spaces, which the city says complies with state law.

The unit categories are 32 Very Low Income units, 21 Low Income units and one market-rate unit for the onsite property manager. National CORE, an affordable housing nonprofit, will own and manage the property.

The city says a waitlist will open as construction nears completion, followed by a lottery to select applicants from that waitlist. That is the leasing process described in the project information.

How did this project reach this site?

The city’s account ties the project to Woolsey Fire recovery funding and a site previously zoned and designated for affordable housing.

HCD sponsored the project. In February 2021, it set aside funding specifically for the region as part of recovery efforts following the Woolsey Fire. The city then identified the previously designated site, according to its project FAQ.

The city also says the project helps address housing needs identified in both its Housing Element and the Agoura Village Specific Plan. Those documents matter to the explanation of why this site is being used.

The city planning documents page is a place to begin checking the planning documents. For related background in another city, the Chino Hills housing priority zoning guide discusses housing element zoning. It doesn’t establish what qualifies in Agoura Hills.

What is the current construction status?

Construction is anticipated, and the city’s update does not say it has started.

As of October 27, 2026, the City of Agoura Hills says construction “is anticipated to begin later this fall” and “is anticipated to be completed in 2028.”

That wording comes from the National CORE Development Information update. Keep the word “anticipated” attached to both parts of the schedule. Neither statement supplies a groundbreaking date or confirms that work has begun.

If timing matters to a property decision, ask Planning whether the posted construction status has changed. The city page explains how to reach planning staff by email.

What does the city say about fire and environmental review?

The city says each project must comply with building requirements for the Very High Fire Hazard Severity Zone and is reviewed and approved by the Los Angeles County Fire Department.

That statement appears in the development information update. The same update says residents of the site will be encouraged to evacuate onto or through Reyes Adobe Road at U.S. 101 during an emergency.

The project FAQ says an evacuation analysis includes future population growth to confirm adequate roadway capacity. It also says the city is improving the traffic signal system for power outages during an evacuation.

These are the city’s statements about the project and its review. The FAQ also posts a federal National Environmental Policy Act (NEPA) notice for the HCD application. Ask Planning about the notice or the review documents if you need more detail.

What should you ask about a different property?

Ask Planning whether the parcel is on the Housing Element sites list or in the Agoura Village Specific Plan area, and what review process applies to it.

The council meeting had been on R.’s calendar because she expected the Agoura Road apartment project to come up for a vote. When the meeting ended without one, she thought the city had postponed the decision. The part she had missed was that a by-right project may be reviewed without the kind of discretionary approval vote residents expect. Once we separated public review from an actual council vote, the absence of a vote made more sense, even though she still wanted to understand what the city could review.

Keep the question tied to the land and the proposed use. A question about an accessory dwelling unit belongs with ADU rules and Planning’s explanation of the applicable process. The apartment project information doesn’t establish rules for single-family homes or identify other eligible sites.

The short version

Agoura Hills says the 54-unit Agoura Road development qualified for by-right approval based on objective standards, without a discretionary City Council approval vote.

The city anticipates construction beginning later in fall 2026 and completion in 2028. Its explanation does not establish eligibility for other parcels. Ask Planning which process applies to the property you’re considering.
