Can Laguna Woods waive building permit fees for accessibility work?

Laguna Woods permit fee relief starts November 16, 2026. Learn who qualifies, what documents to prepare, which fees remain, and what buyers should ask.

If you’re planning accessibility work at a Laguna Woods home, the city has adopted a building permit fee waiver for qualifying veterans and a reduction of half for a person at least 60 with a qualifying disability. The work must accommodate that disability, and the new rule takes effect November 16, 2026.

For an owner preparing improvements or a buyer planning work after closing, the application requirements and timing deserve attention before the permit application.

This is general information and not legal advice.

What did the council adopt?

The Laguna Woods City Council adopted Municipal Code Section 10.02.050 on September 16, 2026, by a 5-0 vote.

The section establishes three programs addressing City-enacted building permit fees: a veteran waiver, a reduction for a person at least 60 with a qualifying disability, and an affordable housing construction reduction.

The council minutes in the October agenda packet confirm adoption. The September staff report and ordinance text give November 16, 2026 as the effective date. You can also find the records through the city’s agendas and minutes page.

What state law allows this relief?

California Health and Safety Code Sections 17951.5 and 17951.7 allow cities to waive or reduce these building permit fees, according to the city’s staff report.

The report quotes Section 17951.5 as allowing cities to “waive or reduce all building permit fees for improvements to the home of a veteran with a qualifying disability that are made to accommodate that disability.”

It quotes Section 17951.7 as allowing cities to “waive or reduce all building permit fees for improvements to the home of a person at least 60 years of age with a qualifying disability that are made to accommodate that disability.”

State law leaves the amount of relief to the city. The adopted section sets Laguna Woods’ amounts and requirements.

Who qualifies for the three programs?

The three programs cover qualifying veterans, a person at least 60 with a qualifying disability, and qualifying affordable housing construction projects.

Under the Veterans with Disabilities Building Fee Waiver Program, the City Manager or designee shall waive all City-enacted building permit fees for qualifying accommodation work. The veteran’s disability must be recognized as service connected by the United States Department of Veterans Affairs.

The Seniors with Disabilities Building Fee Reduction Program reduces those fees by half for accommodation work at the home of a person at least 60. The qualifying disability is defined by Government Code Section 12926(j) and (m).

The Affordable Housing Units Building Fee Reduction Program reduces City-enacted building permit fees by one fifth for construction projects meeting one of three affordability thresholds set out in the code. The units must have an affordability covenant lasting at least 55 years, recorded against the property before final permit approval.

If that covenant is not recorded as required, all previously reduced City-enacted building fees are charged back to the applicant and become immediately due and payable.

What must the accessibility application include?

The veteran and senior programs require a city application form, eligibility and residence documents, and a signed medical statement connecting the disability to the improvement.

Ask the city’s building permit counter or City Hall at 24264 El Toro Road for the form. It calls for the person’s legal name, home address, phone number and email, if any.

Proof of veteran status or age must use the government identification documents listed in the code. For veterans, these include an ID with a veteran designation or a DD214 with photo identification, among the listed options. For the age program, the listed documents are a government-issued driver’s license, identification card, birth certificate or passport.

Residence proof can be a California driver’s license or identification card, or two listed documents in the person’s name. Listed documents include utility bills, bank statements and mortgage statements. Documents generally must be dated within the prior 90 calendar days. Tax returns must be the two most recent; signed leases and stock certificates for residency must be currently effective.

The medical statement must:

  • Be signed and dated by a physician, surgeon, optometrist or osteopathic doctor and include a California license number.
  • State that the person has a qualifying disability requiring the identified home improvement.
  • Be dated within 90 calendar days of the application.

It does not need to disclose the specific qualifying disability.

Can the permit include other remodeling work?

The permit receiving accessibility relief must contain only improvements directly connected to accommodating the qualifying disability of the person residing there.

Other improvements constructed at the same time require separate building permits. A kitchen remodel done alongside the accommodation work therefore needs its own permit, which would not carry this relief.

Say an owner plans accommodation work for a household member who meets one of the programs’ eligibility rules, alongside a kitchen remodel. The owner would ask the city to confirm the accommodation scope, obtain the city form and gather the required documents. The accommodation permit would contain only the directly connected improvements. The kitchen remodel would need its own permit, which would not carry this relief. Before applying, the owner would also check the effective date and ask how the city handles the planned application timing.

Which fees and approvals remain separate?

The relief covers City-enacted building permit fees, with several categories expressly excluded.

State-required charges remain outside the program, including Strong Motion Instrumentation Program fees, known as SMIP, and Building Standards Administration Special Revolving Fund fees, known as SB 1473.

The exclusions also include deposits, development impact fees, encroachment fees, grading fees, in lieu fees and planning fees. Fees adopted by other entities are excluded, including those of the County of Orange, El Toro Water District and Orange County Fire Authority.

Any association approval or fees are separate. Ask the association what applies to your proposed work, and review the association disclosure guide when buying or preparing to sell.

Say an owner plans accommodation work for a household member who meets one of the programs’ eligibility rules. The owner would distinguish the City-enacted building permit fees eligible for relief from charges that remain separate. Even if the accommodation work qualifies for a waiver or reduction, state-required charges and other agencies’ fees would remain outside the program. Any association approval or fees would also remain separate. The owner would ask the city which excluded charges apply and ask the association about its requirements for the proposed work.

What should buyers and sellers check before work starts?

Buyers should confirm permit timing with the city, and owners should keep the permit question in view when planning a later sale.

If you expect to improve the home after closing, note November 16, 2026. The sources do not explain whether relief applies retroactively to permits issued before then. Ask how the effective date affects your planned application before assuming a waiver or reduction.

Fee relief doesn’t replace the permit itself. Read the unpermitted work guide to understand why pulling permits matters when selling later. The seller disclosure guide can also help you prepare questions about documenting and disclosing work.

The short version

Laguna Woods’ new section offers defined building permit fee relief beginning November 16, 2026, subject to eligibility, documentation and project requirements.

Confirm your scope and timing with the building permit counter. Keep concurrent remodeling on separate permits, and ask which excluded charges apply.
