Oakland City Hall · what it means for owners

Will Oakland's S-8 changes affect what can be built?

Oakland is considering S-8 map and code changes for parcels near designated transit stops. The council continued the item to November 10, 2026.

Not yet. Oakland is considering changes that would determine which properties near designated transit stops use SB 79 height and housing density standards, but the council continued its decision to November 10, 2026.

What the city is deciding

The proposal would amend the S-8 code and eligibility map. A parcel is Covered if it is not inside an adopted exclusion. A parcel is Excluded if it is inside an adopted exclusion or, under the proposal, is industrial zoned. Excluded parcels are excluded from the SB 79 property development standards.

Revisions cover state comments, open space and industrial parcels, four excluded Uptown Transit Center stops, and a map reference correction.

Where and who it affects

The proposal is citywide, but applies only within SB 79 transit zones. These include nine zones associated with BART stations and 39 zones associated with AC Transit Tempo stops.

Parcels outside those zones are not affected. Local Register Historic Resources within areas eligible for SB 79 remain excluded.

What it could mean for your property

The updated map would determine whether the SB 79 property development standards apply to an affected parcel.

For parcels adjacent to a transit stop, within 200 feet, the state’s specified minimums are a 95-foot height limit and up to 160 dwelling units per acre near a BART stop. Near a Tempo stop, they are an 85-foot height limit and up to 140 dwelling units per acre. Farther distance bands have lower standards. Projects may use the SB 79 height limit or the local height limit, whichever is higher.

All industrial zoned parcels would be Excluded under the proposal. Possible changes to their zoning or permitted uses would instead be considered during General Plan Update Phase 2.

Open space parcels would leave the ineligible list. The documents do not say which open space parcels would be Covered.

The city documents do not state any effect on property values or prices.

Questions to ask before you buy or build

  • Is the lot inside an SB 79 transit zone?
  • Does the updated S-8 map mark the parcel as Covered or Excluded?
  • Is the property a Local Register Historic Resource?
  • Which height limit applies to the parcel?

What happens next

The council is set to hear the ordinance on November 10, 2026, with a public hearing. The documents read do not say how to submit comments. The city lists Kelly Cha, Planner IV, at (510) 238-2166 as the staff contact.
