The San Marcos City Council has not decided whether to vacate this part of an unnamed road. It will consider the proposal on November 10, 2026.
What the city is deciding
The Council is being asked to approve a summary vacation of about 10,190 square feet of public road right of way. A summary vacation is a shortened process allowed for excess road space that is not needed for street or highway purposes. No public hearing is required.
Where and who it affects
The area is within the Arco Las Posas project at 200 Las Posas Road. The approved project occupies a vacant 1.76 acre commercial site and allows an 18 pump automotive fueling area, a carwash, a convenience store and a drive through restaurant space.
The documents name no residential neighbour. They also do not describe any effect on nearby homes.
What it could mean for your property
If approved, the vacation would remove the public right of way encumbrance from the specified area and allow the private property owner to use it. The proposal applies to the gas station and carwash project site, not to a residential development.
City staff determined that there are no public utilities within the area. The draft findings say the vacation would have no effect on existing improvements or utilities. A public road, utility and drainage easement along Las Posas Road would remain.
The project was approved before the city adopted its Active Transportation Plan. The staff report says that plan could require improvements on part of the right of way, but the documents do not say what those improvements would be.
The city reports no fiscal impact from adopting the resolution. The action is covered by the environmental review adopted for the project and is also described as a minor realignment of right of way.
Questions to ask before you buy or build
- Does the title record show the area proposed for vacation?
- Which public road, utility and drainage easement will remain?
- What use is planned for the vacated area?
What happens next
The Council is scheduled to vote on November 10, 2026, at 6:00 pm. If approved, the area would be vacated and abandoned, and the resolution would be recorded. Comments received by email by 12 p.m. on the meeting day are shared with the Council. Comments may also be made through Zoom or with an in person public comment card.
